Please read these terms carefully before using any Pluritech website, portal, or digital service. By accessing our site you confirm that you have read, understood, and agreed to be bound by every provision set out below.

Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you — whether acting as an individual or on behalf of a legal entity ("you" or "User") — and Pluritech Brasil Ltda, a company incorporated under Brazilian law with registered offices in Brazil, CNPJ 21.724.362/0001-03 ("Pluritech," "we," "us," or "our").

By visiting, browsing, or using any part of pluritech.site or any other digital property operated by Pluritech (collectively, the "Website"), you acknowledge that you have read these Terms in their entirety, that you understand them, and that you irrevocably agree to comply with them. If you do not agree to all of these Terms, you must immediately discontinue your use of the Website.

Use of the Website by persons under 18 years of age is not permitted. By accessing the Website you represent and warrant that you are at least 18 years old and, if you are accessing on behalf of a business, that you have full authority to bind that business to these Terms.

Pluritech grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website solely for the purpose of learning about our technology solutions, managed IT services, software development, and cloud hosting offerings, and for communicating with us through the contact channels made available on the Website.

This licence does not include any right to:

  • Reproduce, copy, redistribute, sell, or commercially exploit any portion of the Website's content, design, or functionality.
  • Use automated tools, crawlers, scrapers, bots, or data-mining applications to extract information from the Website without our express prior written authorisation.
  • Frame or embed the Website or any of its individual pages within another website or application without our written consent.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed on the Website.
  • Reverse engineer, decompile, or attempt to extract the source code of any software component that forms part of the Website.
  • Access or attempt to access administrative areas of the Website, databases, or server infrastructure by any means not expressly authorised in writing by Pluritech.

We reserve the right to suspend or permanently terminate your access to the Website, without prior notice or liability, if we have reasonable grounds to believe that you have violated these Terms or any applicable law.

Section 03

Intellectual Property

All content published on the Website — including, but not limited to, the Pluritech name, logo, brand identity, service names, slogans, visual design, layout, colour schemes, typography, written copy, case studies, technical white papers, illustrations, photographs, video content, icons, and software — is the exclusive intellectual property of Pluritech Brasil Ltda or is used under valid licence from its respective owners.

Such content is protected under Brazilian Law No. 9,279/1996 (Industrial Property Law), Law No. 9,610/1998 (Copyright Law), and applicable international intellectual property conventions to which Brazil is a signatory, including the Berne Convention.

Nothing in these Terms or elsewhere on the Website shall be construed as transferring, assigning, or granting any licence to any intellectual property right except the limited browsing licence expressly described in Section 2 above. Any unauthorised use of Pluritech's intellectual property may give rise to civil liability and may also constitute a criminal offence under applicable Brazilian law.

If you wish to reproduce, adapt, or reference any content from the Website for editorial, educational, or other purposes, you must submit a written request to contato@pluritech.site. Permission will be granted or denied at our sole discretion.

Section 04

User Conduct

When using the Website — including any contact forms, live-chat features, or email addresses provided — you agree to conduct yourself in a lawful, respectful, and professional manner. Specifically, you agree not to:

  • Transmit any content that is defamatory, abusive, threatening, harassing, obscene, fraudulent, or otherwise objectionable, as determined by applicable law or Pluritech's reasonable judgement.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity, in communications with Pluritech or other users.
  • Upload or transmit viruses, malware, ransomware, spyware, or any other malicious code intended to interfere with the Website's operation, the servers hosting it, or any related network infrastructure.
  • Attempt to gain unauthorised access to Pluritech's internal systems, client databases, proprietary software environments, or any accounts belonging to other users.
  • Use the Website to send unsolicited commercial communications (spam) to Pluritech or to collect contact information from the Website for marketing purposes.
  • Take any action that places an unreasonably large load on the Website's infrastructure, or that interferes with or disrupts the integrity or performance of the Website.
  • Use the Website in any manner that violates applicable Brazilian law, including but not limited to the Lei Geral de Proteção de Dados (Law No. 13,709/2018, "LGPD"), consumer protection regulations, or laws concerning electronic commerce.

Any conduct that Pluritech, in its sole discretion, determines to be harmful to the Website, to other users, or to Pluritech's reputation or business interests, may result in immediate termination of access and, where appropriate, referral to the relevant law enforcement or regulatory authorities.

Third-Party Links

The Website may contain hyperlinks to websites, tools, platforms, or resources operated by third parties, including technology partners, software vendors, cloud infrastructure providers, and industry associations. These links are provided solely as a convenience to our visitors and do not constitute an endorsement, sponsorship, or recommendation of the linked website or its operator by Pluritech.

Pluritech has no control over, and accepts no responsibility for, the content, privacy practices, security standards, terms of service, or availability of any third-party website. When you leave the Pluritech Website by following an external link, you do so entirely at your own risk. We strongly encourage you to review the terms of use and privacy policy of any third-party site you visit.

The presence of a link to a third-party website on the Pluritech Website does not imply that Pluritech has reviewed or approved that website's content, security, or practices. Pluritech shall not be liable for any loss or damage arising from your use of, or reliance on, any third-party website.

Section 06

Disclaimer of Warranties

The Website and all of its content, features, and functionality are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, Pluritech expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose — we make no representation that the Website will meet your specific requirements or expectations.
  • Warranties of accuracy, completeness, or timeliness — while we strive to keep the Website's content accurate and up to date, we do not warrant that all information is error-free, current, or complete at any given time.
  • Warranties of uninterrupted or error-free operation — the Website may be temporarily unavailable due to maintenance, system upgrades, cyberattacks, force majeure events, or other circumstances beyond our reasonable control.
  • Warranties regarding the absence of viruses or harmful components — although we take commercially reasonable precautions, we cannot guarantee that the Website is free from malicious code or security vulnerabilities.

Nothing in this disclaimer affects your statutory consumer rights where such rights cannot be excluded under applicable Brazilian law, including the Brazilian Consumer Protection Code (Lei No. 8,078/1990, "CDC").

Section 07

Limitation of Liability

To the maximum extent permitted by applicable law, Pluritech Brasil Ltda, including its directors, officers, employees, agents, subcontractors, and licensors, shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with:

  • Your access to, or inability to access, the Website or any of its content.
  • Any reliance you place on information, recommendations, or materials published on the Website.
  • Any unauthorised access to, or alteration of, your transmissions or data.
  • Any interruption, suspension, or termination of the Website or any service described on it.
  • Any errors, inaccuracies, or omissions in the Website's content, even if Pluritech has been advised of the possibility of such damages.

Where liability cannot be fully excluded under mandatory provisions of Brazilian law — in particular the CDC — Pluritech's aggregate liability to you for all claims relating to the Website shall be limited to the amount of any fees you have paid directly to Pluritech in the three (3) months immediately preceding the event giving rise to the claim, or BRL 500.00 (five hundred Brazilian reais), whichever is greater.

This limitation of liability reflects the allocation of risk between the parties and is a fundamental element of the basis on which Pluritech provides access to the Website free of charge.

Section 08

Indemnification

You agree to defend, indemnify, and hold harmless Pluritech Brasil Ltda and its directors, officers, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgements, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Website in a manner that violates these Terms.
  • Any content you submit, post, or transmit through the Website, including contact forms or communication channels.
  • Your violation of any applicable law, regulation, or third-party right, including intellectual property rights, privacy rights, and consumer protection regulations.
  • Any fraud, wilful misconduct, or gross negligence on your part in connection with the use of the Website.

Pluritech reserves the right, at its own expense, to assume exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Pluritech in asserting any available defences.

Section 09

Governing Law & Dispute Resolution

These Terms and any dispute, controversy, or claim arising out of or in connection with them — or their subject matter, validity, breach, or termination — shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict-of-laws principles.

Any legal action or proceeding relating to these Terms or your access to or use of the Website shall be brought exclusively before the courts of the judicial district where Pluritech Brasil Ltda maintains its registered office, and you irrevocably consent to the personal jurisdiction and venue of such courts for this purpose.

Before initiating any formal legal proceeding, both parties agree to attempt in good faith to resolve any dispute through direct negotiation for a period of at least thirty (30) calendar days from the date on which one party notifies the other of the dispute in writing.

Consumer users located in Brazil retain all rights granted to them under the Brazilian Consumer Protection Code (Lei No. 8,078/1990) and related consumer legislation, and nothing in these Terms shall be interpreted as waiving or limiting those statutory rights.

Section 10

Changes to These Terms

Pluritech reserves the right to amend, update, or replace any part of these Terms at any time, at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered users or frequent visitors through a prominent notice on the Website homepage.

It is your responsibility to check this page periodically for changes. Your continued use of the Website after we publish revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue your use of the Website.

We may also, from time to time, publish supplementary terms or policies that govern specific services, features, or campaigns. In the event of a conflict between supplementary terms and these general Terms of Use, the supplementary terms shall take precedence with respect to the specific service or feature they govern.
